Michtine Labs Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs the use of services provided by Michtine, LLC, herein referred to as Michtine. Michtine may at its sole discretion terminate or suspend services to you without notice and without liability if Michtine reasonably believes you have violated this AUP.
User Supplied Content
All services may be used for lawful purposes only. You must not submit, publish, or display on the network any defamatory, inaccurate, abusive, obscene, infringing, or threatening content. In addition, you may not submit, publish, or display any content that violates any US Federal, State, or Local Law. You are solely responsible for the content you make accessible through Michtine's network. You may not use the service to assist any other person or entity to violate any Federal, State, or Local Laws, Ordinances, or Regulations.
Unacceptable Content
You may not publish or transmit via Michtine's service any content that Michtine reasonable believes:
a. Constitutes pornography of any kind.
b. Infringes on another person's trade or service mark, copyright, patent, or other property right Intends to assist others in circumventing copyright protections.
c. Is defamatory or violates a person's privacy.
d. Creates a risk to a person's safety or health.
e. Creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement.
Unacceptable Services
You may not start or run via Michtine's service any of the following services:
Proxies, IRC, Port Scanning, VPN, Warez,Escrow, Hacking/Phreaking/Phishing, torrents or links to any such service.
Spam/Commercial Advertising/Mass Mailings
Shared Hosting: Bulk emailing is strictly prohibited on shared hosting accounts.
VPS/Dedicated Servers/Custom Server Solutions: You must obtain Michtine's advance approval for any bulk e-mail. In order to obtain approval you will need to demonstrate the following:
a. Intended recipients have given their consent to receive e-mail, such as an opt-in process.
b. You have a procedure in place to retain and provide evidence of the recipient's consent, and provide this evidence to Michtine within 72 hours of request.
c. You have a procedure in place to allow a recipient to easily revoke their consent, and you honor those requests in a timely fashion.
d. You have a privacy policy clearly posted for each domain you will be sending mail from.
e. You agree not to obscure the source of your e-mail in any way and include the recipients e-mail address in the body of the message or in the TO field of the e-mail.
f. You agree to comply with the CAN SPAM Act and any other applicable law.
RESOURCE USAGE
Accounts are limited to 25 simultaneous processes.
Customers may NOT do any of the following:
a. Use 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b. Run any software that interfaces with an IRC (Internet Relay Chat) network.
c. Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons.
d. Participate in any file-sharing/peer-to-peer activities or TorrentFlux/RapidLeach type programs.
e. Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
f. Run any type of web spider or indexer
g. Run any type of AutoSurf/PTC/PTS/PPC script
h. Run any type of distributed computing software, including but not limited to SETI@home, Node Zero and Folding@home
i. Run any cron entries with intervals of less than 15 minutes.
j. Use an account as an online storage space for archiving electronic files.
k. Use an account for a primary purpose other than hosting a web site.
RESELLING
Shared hosting clients are prohibited from reselling the resources allotted to their account or hosting sites within their account for a third party. This does not apply to clients hosting websites for immediate family members in most cases. Michtine Labs will be the sole arbiter of what constitutes a “THIRD PARTY”.
LINK SHORTENING SERVICES
If you provide a link shortening service, your links may not be used in spam mailings.
COPYRIGHT
You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:
you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner, or you are otherwise permitted by established United States copyright law to copy the work in that manner.
COPYRIGHT INFRINGEMENT NOTICE (DMCA)
If you believe your copyright is being infringed by a person using Michtine's services, please send your written notice of copyright infringement to:

Your notice must include the following:
a. Identification of the copyrighted work claimed to have been infringed
b. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Michtine to locate the material.
c. Contact information so we can contact you. This includes an email, a phone number, and a mailing address.
d. The following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
e. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
If you file a DMCA request that is not valid, misrepresented or under false pretenses you may be liable for damages, including costs to the other party and legal fees.
NETWORK SECURITY
You may not use the Michtine network to attempt to circumvent authentication or security of any ISP, host, network, or account. This includes, but is not limited to accessing or attempting to access any data that is not intended for the client, probing the security of our or any other network. Michtine will fully cooperate with investigations of security violations including cooperating with Law Enforcement. Anyone who violates system or network security may be liable for criminal or civil liability.
